CLARIFICATION REGARDING INACCURATE INFORMATION RELATED TO KUNAISA

In response to the recent circulation of information issued by Zitadelle AG, which contains inaccurate and potentially misleading statements regarding the nature, functions, and legitimacy of KUNAISA, it is necessary to issue this public clarification in defense of truth, transparency, and proper understanding of the applicable legal framework.

KUNAISA’S POSITION

First and foremost, it is categorically false that KUNAISA has presented itself, does present itself, or intends to present itself as an official authority of the Government of the Republic of Panama. This assertion lacks merit and constitutes a misrepresentation of reality that induces confusion in the sector.

KUNAISA is an entity whose establishment was duly authorized by the General Congress of the Kuna de Wargandí, in the exercise of its powers within the framework of autonomy recognized for indigenous territories.

CLARIFICATION REGARDING THE INQUIRY TO THE BANKING SUPERINTENDENCY

Regarding the inquiry submitted by Zitadelle AG to the Banking Superintendency of Panama, it is important to highlight the following:

Institutional Jurisdiction

The Banking Superintendency has jurisdiction exclusively over banking entities, fiduciary institutions, and those specifically contemplated in its regulatory framework. Therefore, any inquiry directed to this institution regarding an entity whose nature and scope of operations fall outside its legal jurisdiction is procedurally deficient from its inception.

Correct Interpretation of the Response

The fact that the Banking Superintendency confirmed that KUNAISA does not hold a banking or fiduciary license does not, under any circumstances, constitute a disqualification or invalidation of its existence or functions. Rather, it is a logical consequence of KUNAISA not conducting and not intending to conduct activities subject to that oversight.

Regarding the Presented Narrative

Zitadelle AG’s framing of this communication demonstrates a malicious and biased interpretation of the official response, generating a narrative that may be characterized as misinformation or fake news, by suggesting nonexistent irregularities through deliberate omission of appropriate legal context.
